Mercury Proofs - Terms & Conditions

1. Entertainment Purposes Only

Mercury Proofs is intended solely for comedic, entertainment, and parody purposes. All outputs generated are entirely fictional and must not be used to deceive, impersonate, defraud, or mislead others in any real-world context. No outputs should be interpreted as factual or official information.

2. Prohibited Activities

By using Mercury Proofs, you agree not to engage in activities including, but not limited to:

• Scamming, fraud, or impersonation of individuals, companies, or institutions.
• Harassment, abuse, threats, or any form of harm towards other users or maintainers.
• Creation or distribution of misleading, deceptive, or malicious content intended to manipulate or exploit trust.
• Violation of any local, national, or international laws or regulations.
• Reselling the images generated using Mercury Proofs or profiting from them, with or without permission.
• Automating the service's usage, including, but not limited to, attempting to automate our API or automated image generations.
• Degrading other users' experience with the platform.

3. User Responsibility and Indemnification

Users are solely and fully responsible for any content created or distributed through Mercury Proofs. By using the service, you agree to indemnify, defend, and hold harmless Mercury Proofs, its owners, affiliates, and employees from any claims, liabilities, losses, or expenses arising from your experience or misuse of the platform.

4. No Warranties and Limitation of Liability

Mercury Proofs is provided "as-is" and "as-available" without warranties of any kind, whether express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, reliability, or suitability of the service for any purpose. To the fullest extent permitted by law, Mercury Proofs disclaims all liability for any damages, direct or indirect, arising from the use of the platform.

5. Data Collection and Privacy

For security, accountability, and legal compliance, Mercury Proofs only collects IP addresses, timestamps, and usage logs. This information is stored securely and may be used to investigate misuse, enforce policies, or comply with lawful requests. We do not sell user data to third parties. We do not access or review user logs unless required by law or there is a reasonable suspicion of a violation of these terms or a reported incident.

6. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate access to Mercury Proofs at any time, without prior notice, at our sole discretion, including the cancellation of subscriptions without refunds. Access may be locked even if the subscription was previously paid. Such actions may be taken in cases of policy violations, suspicious behavior, or for any other reason deemed necessary to protect the platform and its users.

7. Ownership and Reservation of Rights

All rights, titles, and interests in and to Mercury Proofs, including but not limited to its content, features, and services, are fully reserved. No rights are granted except as explicitly stated in these Terms of Service.

8. Reporting Misuse

If you encounter misuse of Mercury Proofs or believe someone is violating these terms, please report the incident to report@mercuryproofs.com.

9. Changes to Terms

We may update these Terms of Service at any time without prior notice. Continued use of Mercury Proofs constitutes acceptance of the updated terms.
